Terms of Service

These Terms of Service (hereinafter referred to as the 'Terms') set forth the terms and conditions for the use of the services provided by StoryNexus (hereinafter referred to as the 'Service') operated by wywy合同会社(wywy LLC) (hereinafter referred to as the 'Company'). Registered users (hereinafter referred to as 'Users') shall use the Service in accordance with these Terms.

Article 1 (Application)

These Terms shall apply to all relationships between Users and the Company regarding the use of the Service. The Company may establish separate rules of use for the Service (hereinafter referred to as 'Specific Regulations'). These Specific Regulations shall constitute a part of these Terms, regardless of their name. If the provisions of these Terms conflict with the provisions of the Specific Regulations, the provisions of the Specific Regulations shall prevail unless otherwise specified in the Specific Regulations.

Article 2 (User Registration)

Registration for the Service shall be completed when an applicant applies for registration in accordance with these Terms, and the Company approves and notifies the applicant of such approval. The Company may refuse registration if an applicant for registration is deemed to fall under any of the following items, without any obligation to disclose the reason thereof:

  1. When false information has been provided in the application for registration
  2. When the application is from a person who has violated these Terms
  3. Any other cases where the Company deems registration inappropriate

Article 3 (Management of User ID and Password)

Users shall manage their User ID and password for the Service at their own responsibility. Under no circumstances shall Users transfer or lend their User ID and password to a third party, or share them with a third party. When a combination of a User ID and password matches registered information, the Company shall consider such login as being made by the User who registered that User ID. The Company shall not be liable for any damage caused by the use of a User ID and password by a third party, except in cases where the Company has intention or gross negligence.

Article 4 (Fees and Payment Methods)

Users shall pay the usage fees separately set forth and displayed on the website as consideration for the paid portion of the Service, by the method designated by the Company.

Article 5 (Prohibited Acts)

Users shall not engage in the following acts when using the Service:

  1. Acts that violate laws or public order and morals
  2. Acts related to criminal activities
  3. Acts that destroy or interfere with the functionality of the Company's, other Users', or third parties' servers or networks
  4. Acts that may interfere with the operation of the Service
  5. Acts of collecting or accumulating personal information of other Users
  6. Acts of unauthorized access or attempts thereof
  7. Acts of impersonating other Users
  8. Acts of directly or indirectly providing benefits to anti-social forces in relation to the Company's services
  9. Acts that infringe upon the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the Company, other Users, or third parties
  10. Acts of posting or transmitting content on the Service that the Company determines contains or may contain the following expressions:

a. Excessively violent expressions

b. Explicit sexual expressions

c. Expressions that lead to discrimination based on race, nationality, creed, gender, social status, birth, etc.

d. Expressions that induce or promote suicide, self-harm, or drug abuse

e. Other anti-social content that causes discomfort to others

  1. Acts that the Company determines are intended for the following purposes:

a. Commercial activities, such as business, advertising, promotion, solicitation, etc. (excluding those approved by the Company)

b. Sexual acts or obscene acts

c. Meeting or dating members of the opposite sex whom the User does not know

d. Harassment or defamation of other Users

e. Causing disadvantage, damage, or discomfort to the Company, other Users, or third parties

f. Using the Service for purposes other than those intended by the Service

  1. Religious activities or solicitation for religious organizations
  2. Other acts deemed inappropriate by the Company

Article 6 (Suspension of Service Provision)

The Company may suspend or interrupt the provision of all or part of the Service without prior notice to Users if the Company determines that any of the following circumstances exist:

  1. When performing maintenance or updates on the computer system for the Service
  2. When the provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
  3. When computers or communication lines have stopped functioning due to an accident
  4. Any other cases where the Company deems it difficult to provide the Service

The Company shall not be liable for any disadvantage or damage suffered by Users or third parties due to the suspension or interruption of the provision of the Service.

Article 7 (Copyright)

Users may only use, post, or upload information such as text, images, and videos for which they own the necessary intellectual property rights, such as copyright, or for which they have obtained permission from the necessary rights holders.

The copyright of text, images, videos, etc. posted or uploaded by Users using the Service shall be reserved to the User or other existing rights holders. However, the Company may use text, images, videos, etc. that have been posted or uploaded through the Service to the extent necessary for improving the Service, enhancing its quality, correcting deficiencies, or promoting and advertising the Service, and Users shall not exercise their moral rights of authors with respect to this use.

Except as provided in the main text of the preceding paragraph, the copyright and other intellectual property rights for all information related to the Service shall belong to the Company or the rights holders who have granted the Company permission to use them, and Users shall not reproduce, transfer, lend, translate, modify, reprint, publicly transmit (including making transmittable), transmit, distribute, publish, or use for business purposes, etc. without permission.

Article 8 (Restriction of Use and Cancellation of Registration)

The Company may delete posted data, restrict Users from using all or part of the Service, or cancel User registration without prior notice if a User is deemed to fall under any of the following items:

  1. When they have violated any provisions of these Terms
  2. When it is discovered that the registered information contains false information
  3. When the credit card provided by the User as a payment method has been suspended
  4. When there is a default in the payment of fees or other obligations
  5. When there is no response to contact from the Company for a certain period
  6. When the Service has not been used for a certain period of time since the last use
  7. Any other cases where the Company deems the use of the Service to be inappropriate

If any of the items in the preceding paragraph applies, Users shall lose the benefit of time for all obligations to the Company and shall immediately pay all debts they owe at that time in a lump sum. The Company shall not be liable for any damage caused to Users by actions taken by the Company pursuant to this Article.

Article 9 (Withdrawal)

Users may withdraw from the Service through the withdrawal procedure specified by the Company.

Article 10 (Disclaimer and Exemption)

The Company does not explicitly or implicitly guarantee that there are no defects (including defects concerning safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, bugs, errors, infringement of rights, etc.) in the Service, either legally or factually.

The Company shall not be liable for any damage caused to Users arising from the Service, except in cases where the Company has intention or gross negligence. However, this exemption provision shall not apply if the contract between the Company and Users regarding the Service (including these Terms) constitutes a consumer contract under the Consumer Contract Act.

Even in the case set forth in the proviso of the preceding paragraph, the Company shall not be liable for any damage caused to Users by special circumstances (including cases where the Company or Users have foreseen or could have foreseen the occurrence of damage) due to the Company's default or tort resulting from the Company's negligence (excluding gross negligence).

Compensation for damages caused to Users due to the Company's default or tort resulting from the Company's negligence (excluding gross negligence) shall be limited to the amount of usage fees received from the User in the month in which the damage occurred.

The Company shall not be liable for any transactions, communications, or disputes arising between Users and other Users or third parties regarding the Service.

Article 11 (Change of Service Content)

The Company may change, add, or abolish the content of the Service with prior notice to Users, and Users agree to this.

Article 12 (Change of Terms)

The Company may change these Terms without individual consent from Users in the following cases:

  1. When the change to these Terms is in accordance with the general interests of Users
  2. When the change to these Terms does not contravene the purpose of the Service use contract, and is reasonable in light of the necessity of the change, the appropriateness of the content after the change, and other circumstances related to the change

When changing these Terms pursuant to the preceding paragraph, the Company shall notify Users in advance of the fact that these Terms will be changed, the content of the Terms after the change, and the effective date thereof.

Article 13 (Handling of Personal Information)

The Company shall handle personal information obtained through the use of the Service appropriately in accordance with the Company's 'Privacy Policy.'

Article 14 (Notification or Communication)

Notification or communication between Users and the Company shall be conducted in the manner specified by the Company. Unless the Company receives a notice of change in accordance with the method separately specified by the Company, the Company shall consider the currently registered contact information to be valid, send notifications or communications to that contact information, and deem these to have reached the User at the time of transmission.

Article 15 (Prohibition of Transfer of Rights and Obligations)

Users may not transfer their position under the usage contract or rights or obligations based on these Terms to a third party, or provide them as collateral, without prior written consent from the Company.

Article 16 (Governing Law and Jurisdiction)

The interpretation of these Terms shall be governed by the laws of Japan. In the event of a dispute regarding the Service, the court having jurisdiction over the location of the Company's head office shall have exclusive agreed jurisdiction.
